In a stunning turn of irony, James filed a motion to dismiss federal charges alleging she falsified information for favorable mortgage terms, arguing the case stems from President Donald Trump’s personal vendetta over her prior legal actions against him, including a 2022 lawsuit that slapped his organization with a massive financial penalty, as Breitbart reports.

Let’s start at the root of this legal showdown—back in 2018, during her campaign for New York’s top law enforcement post, James made it crystal clear she intended to target powerful figures like Trump, who faced numerous investigations and allegations of misconduct at the time.

Campaign Promises Fuel Legal Battles

During her victory speech that year, James declared, “As the next attorney general of his home state, I will be shining a bright light into every dark corner of his real estate dealings, demanding truthfulness at every turn.”

That’s a lofty pledge, but conservatives might see it as a preemptive strike—vowing to hunt down the current president of the United States before any evidence was on the table smells more like politics than justice, a tactic progressives often wield under the guise of accountability.

Fast forward to 2022, when James acted on that promise, filing a lawsuit against Trump and several Trump Organization executives, accusing them of inflating property values to snag better loan terms, a case that yielded a $350 million judgment, later ballooning past $500 million with interest.

Trump Lawsuit Sparks Retaliation Claims

Despite no lenders reporting financial harm, an appeals court upheld the fraud finding while trimming the penalty, with both sides now appealing—a legal slugfest that’s kept tensions boiling between James and Trump.

Her motion filed on November 7, 2025, claims this history sparked six years of targeted hostility from Trump and his allies, pointing to harsh labels like “crooked” and “scum” as evidence of personal animus driving the mortgage fraud charges against her.

The filing argues, “The government targeted AG James for prosecution because of the President’s genuine animus towards her protected campaign speech and fulfillment of her statutory obligations as New York Attorney General.”

Irony in Selective Prosecution Argument
