Judge challenges California officials over alleged gender policy deception

California’s progressive agenda faces a blistering rebuke as a federal judge threatens sanctions over apparent deceit in a case about hiding students’ gender identities from parents.

On Wednesday, U.S. District Judge Roger Benitez accused California officials, including Attorney General Rob Bonta and the state Department of Education, of misleading the court by relocating contested gender secrecy policies from a public FAQ page to a mandatory teacher training module, prompting a show-cause order for Nov. 17, as Just the News reports.

Benitez, appointed by President George W. Bush, issued a stern order targeting California’s leadership. He called out Bonta and the California Department of Education (CDE) for potentially deceiving the court. This stems from a high-stakes legal battle over student privacy policies.

Courtroom Clash on Gender Secrecy Rules

The lawsuit, brought by teachers and parents of children with gender incongruence, contests a state mandate. It alleges California forces schools to withhold students’ asserted gender identities from parents, effectively silencing educators. This clash pits family rights against state-driven progressive policies.

Bonta and CDE argued for dismissal, claiming the issue was resolved by removing an FAQ page with the disputed guidelines. They insisted this made the case moot, as it was their sole link to the litigation. Yet, the judge uncovered a troubling twist in their narrative.

Evidence from the Thomas More Society, representing the plaintiffs, revealed that the FAQ content wasn’t gone. Instead, it resurfaced in a required PRISM teacher training module. Benitez demanded the state explain this maneuver by Nov. 17 or face sanctions.

Training Module Sparks Misleading Claims

"From day one, officials from the local school district all the way to the governor’s mansion have tried to deflect responsibility but have now been caught not only lying to California taxpayers but attempting to mislead the Court to escape accountability," said Peter Breen, executive vice president of the Thomas More Society.

For conservatives, this reeks of a deliberate shell game by state bureaucrats pushing a radical agenda. When transparency is dodged to shield policies undermining parental rights, trust in governance erodes. It’s a stark reminder of why oversight matters.

The PRISM training, mandated under the California Safe and Supportive Schools Act, was shaped by advocacy groups like the ACLU and Trevor Project. It instructs schools to keep a student’s LGBTQI+ status secret from parents without consent. Only in rare safety or wellness cases can disclosure occur.

Parental Rights Versus State Overreach

A Nov. 3, California Family Council article highlighted PRISM slides echoing the old FAQ’s language. It even misrepresents the Family Educational Rights and Privacy Act (FERPA), wrongly suggesting it bars sharing gender details with parents. FERPA, in truth, upholds parental access to records.

Plaintiffs also secured a video of Superintendent Tony Thurmond introducing PRISM, parroting the FAQ’s “rare exceptions” for disclosure. The state refused to clarify what constitutes a “need to know” in discovery responses. This vagueness only fuels suspicion of intentional obfuscation.

"It is not possible to speculate about every potential scenario where it might be warranted to disclose a pupil’s gender nonconforming status without permission," the state defendants responded during interrogatories.

Judicial Pushback on Progressive Policies

This evasive stance grates on those who value clear family authority over state intrusion. If California’s leaders can’t define their own rules, how can parents trust them with sensitive matters? It’s a policy quagmire begging for accountability.

Judge Benitez, who certified classes to challenge these secrecy rules last month, has consistently backed the plaintiffs. He denied dismissal motions and shielded teachers from retaliation. A summary judgment hearing looms next week, promising more fireworks.

As President Donald Trump champions traditional values, California’s tactics spotlight a broader cultural divide. Bonta’s office dodged comment, deferring to CDE, who also stayed silent. For conservatives, this case isn’t just a legal dispute -- it’s a fight for the soul of parental rights.
