Texas Judge Indicted for Restraining Attorney in Court

 February 2, 2026

A Bexar County judge in Texas, Rosie Speedlin Gonzalez, surrendered to authorities on Thursday after a grand jury indicted her on serious charges stemming from a courtroom incident. The 60-year-old jurist faces allegations of ordering a defense attorney to be handcuffed and confined during a hearing.

Gonzalez, who took office in 2019 as the first openly LGBTQ judge elected in Bexar County, is charged with felony unlawful restraint by a judicial officer and misdemeanor official oppression following a December 2024 clash with attorney Elizabeth Russell. No court date has been set as of Thursday.

Judge Faces Felony Over Courtroom Incident

Critics argue that this case raises profound concerns about judicial overreach and the potential abuse of authority in Texas courts. Many on the right question whether personal ideologies are influencing courtroom conduct. The incident has sparked significant debate over the boundaries of judicial power.

The charges against Gonzalez originated from a December 2024 hearing, according to court transcripts. During the session, defense attorney Elizabeth Russell requested to confer with her client after a “true” plea to a probation violation. Gonzalez denied the request, asserting that attorneys must not coach clients.

When Russell objected to the denial, Gonzalez allegedly directed the bailiff to detain her. The attorney was reportedly handcuffed and placed in the jury box. Such actions, if proven, suggest a troubling disregard for professional decorum in the courtroom, the Daily Caller reported.

Legal Consequences and Past Controversies

The grand jury handed down an indictment on one felony count of unlawful restraint by a judicial officer, carrying a potential penalty of up to 20 years in prison. Additionally, Gonzalez faces a misdemeanor count of official oppression. A special prosecutor was appointed after the local district attorney’s office stepped aside.

Gonzalez, who is seeking reelection in the March Democratic primary, issued a public statement after turning herself in. “I’m a proud public servant, I’m LGBTQ, I own a gun, I’m bilingual, I’m an American citizen — and I have every right to defend myself,” she said to the media.

Conservatives find it ironic that a judge invoking her rights to self-defense is accused of denying basic professional courtesies to an attorney in her courtroom. If the allegations hold, this incident could undermine public trust in an already polarized judicial system. Accountability must be the priority here.

History of Public Attention

Before this incident, Gonzalez drew national notice for displaying a pride flag in her courtroom. She fought a multi-year legal battle over this right and ultimately won on appeal in 2023. This history adds another layer to her public profile.

In 2022, Gonzalez paid a civil penalty after Transportation Security Administration agents discovered a loaded handgun in her carry-on at San Antonio International Airport. This prior misstep, though unrelated to her judicial duties, contributes to scrutiny of her judgment. Public officials must uphold the highest standards.

For many on the right, these past events suggest a pattern of behavior that prioritizes personal expression over professional restraint. While everyone deserves due process, repeated controversies raise questions about fitness for the bench. Voters may take note in the upcoming primary.

Current Status and Implications

As of Thursday, the State Commission on Judicial Conduct has taken no action against Gonzalez. This lack of immediate response leaves the case in limbo for now. Observers await further developments to see if additional oversight will emerge.

Gonzalez’s statement emphasizes her identity and rights as a defense against the charges. “I’m a proud public servant,” she reiterated, highlighting her multifaceted background as a point of pride amid legal challenges.

From a conservative perspective, this defense misses the core issue: alleged misuse of judicial authority. While personal identity is irrelevant to the charges, the focus should remain on whether Gonzalez overstepped her role. Justice demands clarity, not distraction, in resolving this serious matter.
