The 8th U.S. Circuit Court of Appeals declined to reinstate restrictions on federal agents at Minnesota protests, siding with the Trump administration. This decision denied the American Civil Liberties Union’s request to restore limits on federal personnel following a fatal shooting over the weekend, while the court expedites the administration’s broader appeal.
The issue has sparked intense debate over federal authority and protest rights. Critics of the lower court’s restrictions argue they hinder law enforcement’s ability to maintain public safety. Supporters of the Trump administration view this as a necessary check on judicial overreach.
According to The Hill, this lower court ruling came after residents filed a lawsuit on Dec. 17, alleging First Amendment violations by officers during protests in the Twin Cities. The protests erupted as federal resources arrived in the area.
The Trump administration contested Menendez’s authority to issue such restrictions, asserting they jeopardized immigration officers and public safety.
On Monday, the 8th Circuit panel agreed, finding the earlier order too broad and vague in scope.
In an unsigned opinion, the appeals court noted the risk of contempt due to unclear directives in the district court’s order. The ruling stands until the 8th Circuit resolves the administration’s expedited appeal in due course.
“A wrong call could end in contempt, yet there is little in the order that constrains the district court’s power to impose it,” the panel stated. This highlights a key flaw in the original restrictions, per the court’s view.

Initially, the 8th Circuit had paused Menendez’s restrictions pending further litigation. Following the shooting, the ACLU urged the court over the weekend to reinstate the limits, citing heightened risks, but the ruling omitted mention of the incident.
“As federal agents claim they can act with impunity and kill people in our streets, this ruling is incredibly disappointing,” said Deepinder Mayell, ACLU of Minnesota executive director. He emphasized the right to protest without fear of harm.
Conservatives argue that while tragic, the shooting does not justify blanket restrictions that could cripple federal operations. Public safety must remain paramount, especially for agents enforcing immigration laws under President Trump’s leadership.
Of the three-judge panel, all were appointed by Republican presidents: Judges Raymond Gruender and Bobby Shepherd by George W. Bush, and David Stras by Trump. Gruender dissented in part, supporting a specific ban on pepper spray against peaceful protesters, but the majority held firm.
