Manhattan DA opens investigation into sexual assault allegations against Rep. Eric Swalwell

 April 12, 2026

The Manhattan District Attorney's Office has launched a criminal investigation into sexual assault allegations against California Rep. Eric Swalwell, publicly urging anyone with knowledge of the claims to contact its Special Victims Division. The probe centers on accusations from a former staffer who says Swalwell assaulted her in a New York City hotel room after a charity gala in April 2024.

The move marks a sharp escalation for a sitting congressman already facing political fallout. Within 24 hours of the allegations becoming public, Swalwell lost every Democratic endorsement backing his campaign for California governor, according to a Fox News report on the rapid collapse of his party support.

What the accuser says happened

A former Swalwell staffer told CNN that after attending a charity gala with the congressman in New York City in April 2024, she was heavily intoxicated when she returned to her hotel room. She said she woke up to find Swalwell having sex with her.

"I was pushing him off of me, saying no. He didn't stop."

The former staffer's account, as reported by the BBC, places the alleged assault squarely within Manhattan's jurisdiction, which is why the DA's office has taken up the matter. The woman described a pattern of misconduct, including an earlier alleged incident in 2019 in which she said she woke up naked in Swalwell's hotel bed after heavy drinking, Breitbart reported.

Swalwell has denied the allegations. His specific public statements responding to the claims have not been detailed beyond that denial in the available reporting.

The DA's public appeal

DA Alvin Bragg's office did not limit itself to a quiet investigation. A spokesperson issued a public statement encouraging others to come forward.

"We urge survivors and anyone with knowledge of these allegations to contact our Special Victims Division at 212-335-9373."

The office added that its "specially trained prosecutors, investigators and counselors are well-equipped to help you in a trauma-informed, survivor-centered manner." That language signals the DA views this as a case that may involve additional complainants beyond the former staffer.

The public appeal is notable for its directness. Prosecutors do not always broadcast open investigations involving public officials, and the decision to do so here suggests the office believes additional witnesses or victims may exist. Bragg's office has drawn scrutiny from conservatives in recent years for its handling of politically charged cases, including the allegations from Michael Cohen that Bragg and Attorney General Letitia James pressured his testimony against former President Trump.

Three more women come forward

The former staffer is not the only accuser. CNN reported that three additional women described alleged sexual misconduct by Swalwell, ranging from nonconsensual sex to inappropriate messages, including nude photographs, the Washington Times confirmed.

The identities of these three women have not been made public. The specific dates, locations, and circumstances of their allegations remain unclear. Investigators will need to determine whether any of those additional claims fall within Manhattan's jurisdiction or whether other prosecutors might take interest.

No charges have been filed against Swalwell. The investigation is in its early stages, and the congressman has not been arrested or formally accused in any court filing. Every allegation remains just that: an allegation, subject to investigation and whatever evidence prosecutors can develop.

Political fallout hit fast

The speed of the political damage was striking even by Washington standards. Fox News reported that Swalwell lost all of his Democratic endorsements within a single day. For a congressman running a statewide campaign for governor, the collapse of party support represents a potentially fatal blow to his political ambitions regardless of how the criminal investigation unfolds.

Several Democrats withdrew their endorsements and urged Swalwell to end his gubernatorial bid, Breitbart reported. The names of those specific Democrats were not detailed in the available reporting.

Swalwell has served in Congress since 2013, representing California's 15th Congressional District. He gained national attention during the Trump impeachment proceedings and later faced questions about his past association with a suspected Chinese intelligence operative. That episode, while unrelated to the current allegations, established a pattern in which Swalwell's personal conduct drew public scrutiny.

What investigators must determine

The Manhattan DA's Special Victims Division now faces several critical questions. Prosecutors will need to assess the credibility and consistency of the former staffer's account, gather physical evidence if any still exists from the April 2024 incident, and determine whether hotel records, surveillance footage, or witness testimony corroborates the timeline.

Investigators have not said whether they have obtained a search warrant, subpoenaed records, or interviewed Swalwell. The congressman's cooperation or lack thereof with the probe has not been publicly disclosed.

The broader question of how the Manhattan DA's office handles high-profile investigations will draw attention from both sides. Bragg's office has faced persistent conservative criticism over its prosecution of Donald Trump, with Trump's lawyers seeking federal review of his hush money conviction and raising questions about prosecutorial overreach in that case.

Whether the office applies the same prosecutorial vigor to a Democratic congressman that it brought against a Republican president will be closely watched. The investigation also unfolds against a backdrop of broader New York political and legal battles, including a second criminal referral against Attorney General Letitia James sent to the DOJ by FHFA Director Pulte.

A pattern question looms

The presence of multiple accusers, if their accounts hold up under investigation, could transform this from a single disputed encounter into something far more damaging. Pattern evidence often proves decisive in sexual assault prosecutions, where individual cases can devolve into credibility contests.

Authorities have not publicly confirmed whether the three additional women have spoken with the DA's office or whether their allegations are being investigated alongside the former staffer's claims. The DA's public call for additional contacts suggests prosecutors want to cast a wide net.

No timetable has been set for the investigation. Grand jury proceedings, if they occur, would take place behind closed doors. Swalwell retains his congressional seat and has not indicated any plans to resign.

The question now is whether the Manhattan DA's office will pursue these allegations with the same intensity it reserves for its most prominent targets, or whether political considerations will shape the pace and scope of the probe. Conservatives have reason to watch closely. The answer will say as much about the institution as it does about the accused.
