Supreme Court Considers Trump’s Carroll Verdict Appeal

Lorna Morales,
 January 29, 2026

The Supreme Court is poised to evaluate a significant petition from President Donald Trump, challenging a 2023 civil verdict tied to allegations by E. Jean Carroll. This development, set for discussion on Feb. 20, 2026, could reshape the legal landscape surrounding the current president of the United States.

The Supreme Court justices will hold a private conference to review multiple petitions, including one from President Donald Trump seeking to overturn a 2023 civil verdict against him in a lawsuit filed by journalist E. Jean Carroll.

Upcoming Supreme Court Conference Details

The justices could potentially act on Trump’s petition as early as Feb. 23. However, court procedures often involve discussing petitions across two or more conferences before a final decision, as noted by SCOTUS Blog. A ruling might not emerge until March 2 or later, Fox News reported.

The lawsuit stems from claims by Carroll, a journalist and advice columnist, who alleged an incident involving Trump in 1996 at Bergdorf Goodman in New York City. She filed two lawsuits after publishing a book in 2019 detailing her accusations.

Trump has steadfastly rejected these claims, maintaining his innocence throughout the legal proceedings. The 2023 verdict against him has now prompted this appeal to the nation’s highest court for reconsideration.

Legal Arguments in Trump’s Petition

Critics of the original verdict, including Trump’s legal team, have raised serious concerns about the integrity of the trial process. They argue that the accusations lack supporting evidence and question the timing and intent behind Carroll’s claims, made decades after the alleged event.

In their petition, Trump’s attorneys labeled Carroll’s allegations as lacking credibility and driven by political motives. They contend the lower court made erroneous rulings on evidence that prejudiced the jury against Trump. Trump’s attorneys wrote:

President Trump has clearly and consistently denied that this supposed incident ever occurred. No physical or DNA evidence corroborates Carroll’s story. There were no eyewitnesses, no video evidence, and no police report or investigation. Carroll waited more than 20 years to falsely accuse Donald Trump, who she politically opposes, until after he became the 45th President, when she could maximize political injury to him and profit for herself.

Evidence and Testimony Under Scrutiny

While the above statement from Trump’s legal team underscores a lack of tangible evidence, one must question whether the delay in the accusation truly constitutes a falsehood. Yet from a conservative perspective, the timing raises eyebrows, especially given Carroll’s emergence during Trump’s presidency.

Trump’s attorneys also challenged the inclusion of testimony from Jessica Leeds and Natasha Stoynoff, who made separate allegations against Trump from 1979 and 2005, respectively. They cited inconsistencies and credibility issues with these accounts as reasons for exclusion.

Furthermore, the legal team objected to the use of a 2005 “Access Hollywood” recording in which Trump made controversial remarks. They argued this unfairly swayed the jury’s perception in the Carroll case.

Broader Implications of the Case

Carroll’s attorney, Roberta Kaplan, has expressed skepticism about the Supreme Court taking up the case. “We do not believe that President Trump will be able to present any legal issues in the Carroll cases that merit review by the United States Supreme Court,” Kaplan said, per The Associated Press.

Yet, for many conservative observers, Kaplan’s confidence might overlook the potential for judicial overreach in lower court decisions. If the Supreme Court declines to intervene, it could signal a troubling precedent for politically charged lawsuits against public figures like Trump.

Ultimately, this case extends beyond a single verdict, touching on broader issues of fairness in legal proceedings. For supporters of the current president, ensuring an impartial review by the Supreme Court is essential to safeguard against what they see as a weaponized justice system.
